Terms of use

These terms are for toru, a private photo journal, and for this website. They are between you and Daniel, who builds toru. Using the app or the site means these terms apply.

What toru is

toru keeps the memories that matter. A print has two sides: the photo in front, your words behind it, a date and a place carried with it.

The archive lives on the phone. No account. No cloud. Nothing is uploaded by the app.

Licence

The App Store grants a personal, non-exclusive licence to use toru on devices you own or control. The app itself stays Daniel's. The licence lasts until it is ended, by deleting the app or by these terms ending.

You own the photographs and the words you keep. toru does not claim them.

The archive

Every memory lives on this device. Deleting the app deletes the archive on that device, unless a backup file was made or the phone itself is restored.

A backup is one file, encrypted with a passphrase only you know. Keeping that file, and the passphrase, is yours to do. If the phone is lost, the app is deleted, or the file cannot be opened, Daniel cannot bring the archive back.

Settings can erase the archive on this device. That cannot be undone from inside the app.

Sharing

A print leaves the phone only when you send it.

This website

The waitlist collects an email so the release notification can be sent. That list is described on the privacy page. Do not use the site to break the law or to interfere with it.

Purchases

If something in toru is paid for through the App Store, Apple handles the payment. Apple's terms for that store apply to the purchase. Daniel does not receive card details.

Keeping memories is not gated.

Fair use

toru is for personal use. Do not use it to break the law. Do not try to read an archive that is not yours.

As it is

toru is offered as it is. A memory can be lost. A notification can be missed if the app has not been opened in some time. Daniel is not responsible for lost memories, or for anything that happens to a print after it is sent off the phone.

Apple

These terms are not an agreement with Apple. Apple has no obligation to support toru, and is not responsible for the app or its content. Claims about toru are Daniel's to answer.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them.

Purchases and downloads through the App Store are also covered by Apple's Licensed Application End User License Agreement.

Changes

If these terms change, the new ones will be on this page with a new date. Using toru after that date means the new terms apply.
